美国的学生公寓对搬出公寓时的住户责任义务有很严格的规定,不了解这些规定,扣押金事小,严重的可能会给自己带来巨额罚款。

转租与退租相关FAQ:

我签订了12个月的租约合同,可以中途转租(sublease)或者退租么?

可以,公寓一般都有正式的转租条款,正规转租手续完成之后,你将不会对房子再有任何的财务责任。一般转租都有一定的转租费用,承租人也需要额外支付申请费、管理费、押金等。因此也有很多同学选择不经过公寓,私下转租。退租也需要遵照公寓规定,缴纳违约金。

如果在租约结束前我自行搬出,会有什么样的后果?

租约到期前可以搬出,但是你仍旧需要支付租约中剩余几个月的房租,或者将房间sublease出去,由他人继续支付房租,否则即为毁约。请同学们一定注意:毁约不仅仅意味着押金损失,公寓有权追缴你剩余的所有房租。同时对你个人的信用记录等产生严重影响,有些公寓甚至会反映给移民局。拒不缴付房租,公寓还可能诉诸法律。

转租时需要注意的问题有哪些?

建议与第二租赁方及公寓确认完成转租所需办理的手续, 确保自己已不再对之前的合约负有任何法律责任。如果是私人转租,同学们更需要注意1)这些都是私人行为,没有任何法律效力;2)一经发现,公寓很可能会追究你的责任。鉴于私人转租有一定风险,还请同学们和承租者提前谈妥,保护好自身利益。

退租时需要注意哪些问题?

退租时,你需要基本将公寓还原成你入住时的样子,即清洁公寓、不留下任何私人物品或垃圾、公寓各项设施完好无损等。需要填写Move-out checklist, 与公寓的工作人员一一的检查所需清洁的地方是否达到标准,以确保押金可以全额退款。别忘了将正确的支票抬头以及邮寄地址留给公寓。退还押金的支票通常在一个月内会收到。

我已经搬出,但是收到了公寓的账单,为什么?我该怎么做?

一般来讲, 公寓会将扣款的明细逐一列出, 若觉得某部分不合理, 可以打电话或发邮件向公寓经理询问。由于每个人的情况不同,如果觉得不合理,可以协商。如果双方无法协调,不妨寻找学校的免费律师进行咨询


关于具体的在搬出当天需要做的事情,公寓一般都有一份《搬出须知》提前发到你的手上。美国学生公寓的要求基本大同小异,下面这份文件是某公寓发给住户的“搬前必读”,非常典型,让我们一起来学习一下(没耐心的同学直接看中文部分):

In order tomake your move-out go as smoothly as possible, please follow these instructionsvery carefully. We all wish you the bestof luck in your future endeavors!

CHECK-OUT TIME:

Your keys must be turned into therental office by NOON Wednesday, July 31st as our inspections will begin atthat time. Should you not vacate your apartmentby 12:00 p.m., there will be a overstay fee of $100 per hour assessed to youraccount. If you intend to move out before the 29th you may sign upfor a move out inspection by calling or stopping by the office to schedule aspecific time. Inspection appointmentsare on a first-come, first-serve basis with the last day of inspections beingMonday, July 29th at 4:00pm. Inspections will not be conducted at anytime after 4:00pm on the 29th. You must be prepared to turn in your keys atthe time of inspection as you will not be allowed to return to the unit. Damage/cleaning charges are not consideredfinal at the time of inspection.

*租约结束时间:在这个时间之前必须彻底搬出。

所谓彻底搬出,主要指两个步骤,第一,带走所有个人物品,清洁房间完毕。第二,交钥匙。交过钥匙就意味着你将不能够再次返回房间,而公寓对房间的检查即将开始。所以,为了避免罚款,大家务必要在交钥匙之前确保公寓已经恢复到搬入时的样子,并且,规定时间之前必须交回钥匙。

ITEMS LEFT IN THE APARTMENT OR IN THE PARKING LOT:

Please make sure to remove anybicycles from the bike racks and to remove your vehicle from the property uponmoving out. We are NOT responsible forany personal items left in the apartment or on the property. For any removal of personal items, a $25.00 feewill be charged per bag of trash. Anypersonal furniture left in the apartment will be removed at a charge of $100.00-$150.00per piece of furniture. We WILL NOTstore any items left in the apartment as any remaining items will be discarded.

CLEANING:

Please make sure that all personalitems are removed and that your apartment has been left in a clean and orderlycondition. If you moved into an ‘As-Is’unit you are still responsible forleaving the apartment in a clean and orderly condition upon move out. Common area cleaning and damages willbe charged evenly among your roommates unless the responsible party signsthe Responsibility Acceptance Letter sheet that is included in this packet. We have included a list of average damage and cleaning charges inthis packet. If the owner incurs a greatercost for cleaning or repairing an item, you will be responsible for paying thegreater cost.

*如果你对自己的清洁能力并不自信,或者干脆嫌麻烦,可以找专业的清洁公司来清理,很多保洁公司都有专门的move-out cleaning套餐选择。在清洁服务完成后,你会从保洁公司那里拿到一份确认单,请核对这份单子上确认完成清洁的部分已经meet了公寓checklist上的所有要求。交钥匙时请将单子一起交给公寓,这样,如果公寓再次发现问题,将会直接找保洁公司,你将不需要承担责任,每人50刀左右的清洁费可能将帮你省掉上千刀的罚款,所以,不失为一个省时省力的好方法。

**Please Note: This is not anall-inclusive list. You can be chargedfor cleaning items not on this list. **

REFRIGERATOR- The refrigerator and freezer should be cleared ofALL food and debris. Please remember toclean the floor under the refrigerator and both sides of the refrigerator. Please clean the entire inside of therefrigerator with a household cleaner. Be sure to leave the ice bin that came with the freezer. PLEASE LEAVE REFRIGERATOR ON!

STOVE-Make sure that the range top, drip pans, burners, & under burners arecleaned of ALL grease and grime. Theunder burner is the part of the stove under the drip pans. The oven MUST bethoroughly cleaned with a household cleaner. We suggest you replace the drip pans before moving out. They can be purchased at Wal-Mart or Lowe’s.

MICROWAVE-The microwave must be free of ALL food and debris. Please clean the inside and outside of themicrowave with a household cleaner.

BATHROOM-

1. SHOWER: The shower stall andtub should be thoroughly cleaned, using a household cleaner. Bleach and a small brush, such as an oldtoothbrush, or a scrub brush will help with cleaning those hard to get cleanareas, such as soap scum rings around the tub. Tub caulking should be free of stains and mildew and all shower curtainsand rings must be removed aswell.

2. TOILET: Please make sure that you clean the entire toilet with atoilet bowl cleanser. DO NOT forget toclean the lid and the entire base of the toilet.

3. SINK: Clean the entire sink and counter with a householdcleaner. DO NOT forget to clean thefaucet. For hard to remove scum wesuggest using a brush and cleaner.

4. MIRROR: Remember to clean the mirror with a window cleaner.

5. FLOOR: Scrub the floor thoroughly and DO NOT forget to scrub behindthe toilet and get along the edges.

6.CABINETS: Please remember to move all personal items. Please clean inside and out with a householdcleaner or window cleaner.

* CARPET- The carpeting throughout the entire apartment must bevacuumed and shampooed if necessary, especially if there is pet damage.

* COVERS– Make sure to check all outlet covers or light switch coversfor cracks and replace them as necessary.

DAMAGES:

Upon your lease termination at 12:00p.m. July 31st, a move-out inspection will be done by our staff. After the inspection of your apartment, themove-in inspection form that you may have completed will be carefully comparedto our move-out inspection and pictures to ensure you are not charged for anypre-existing damages if applicable. Anydamage done to the apartment that is not on your move-in inspection form will be charged to you. ALL CHARGES FOR DAMAGES ARE ASSESSED ON ALABOR AND MATERIALS BASIS AND CURRENT YEAR VENDOR PRICES.

KEYS:

Please return ALL keys (Front Door,Bedroom Door, Mailbox and Amenity Key) by 12:00 p.m. on July 31, 2013 to therental office. DO NOT LEAVE YOUR KEYS INYOUR APARTMENT! You must lock your bedroomdoor and front door upon moving out. Pleaseplace all keys in the provided key envelope and make sure it is clearly labeledwith your building and unit number as well as the bedroom letter. A $25.00 fee for the front door and bedroomkeys, $10 fee for the mailbox key, and $50 for the amenity key, if applicable, willbe assessed to your account if they are not returned by 12:00pm July 31st.Keys must be turned in by noon onJuly 31st or a $100 overstay fee will be assessed.

*关于交钥匙:

交钥匙需要注意四点:第一,必须交还到指定地点,不要把钥匙留在房间内。第三,交钥匙前记得锁好房间门和客厅门;第三,要标好哪一把钥匙开哪个锁,公寓一般会有标好的信封发给你,请弄好对应关系后放入,遗失会产生费用。第四,房间、unit、信箱等入住时公寓给你的所有钥匙必须要在规定时间前交回,任意一把钥匙的迟交都会产生费用。

FINAL UTILITY BILL:

Your final Conservice bill will beprorated by the total bill from the prior month. You will receive this bill around July 15th,2013.

*关于水电费账单:

如果你的公寓不包所有utilities,那么搬出公寓前,请确认自付的utilities部分最后一个月的账单已经还清。

SECURITY DEPOSIT:

Your statement of security depositwill be postmarked to you within 30 days. Please be sure that you fill out theprovided forwarding address form for failure to leave a forwarding address cancause a delay in the receipt of any security deposit return that you may beentitled to. If a forwarding address isnot provided upon move out we will use the address listed on your application.

*关于押金返还:

公寓一般会在你搬出后的30天内,以寄支票的形式退还押金,请务必提供给公寓你接收支票的有效地址。

CHANGE OF ADDRESS:

Don’tforget to check your mail one last time before turning in your mailboxkey. Please remember to notify the postoffice of your new address. Please visitwww.usps.com to submit a change ofaddress/forwarding form as you areresponsible for changing your address. Any mail delivered to the property after July 31st, 2013 willbe returned.

*关于地址变更:

请在交回信箱钥匙之前最后检查信箱,并在交回钥匙之后,及时登录www.usps.com修改接收地址,否则公寓会将你搬出日期之后的所有信件退回给寄件人。
